Official letter No. 2446/BHXH-QLT dated November 29th, 2018 of Vietnam Social Security regarding temporary guidelines on participation in compulsory social insurance with regard to foreign workers

Accordingly, foreigners working in Vietnam have to pay social insurance contributions if they enter into labor contracts with terms of at least 01 year, except for the cases of “internal transfer” or “reach of retirement ages”.
In case a foreign worker at the same time enters into multi labor contracts with terms of at least 01 year, he/she has to pay social insurance contributions in terms of the first labor contract while accident occupation insurance premiums have to be paid for all labor contracts.
The payment of social insurance contributions shall be made from December 1st, 2018. However, only enterprises are required to make the social insurance contributions, including 3% paid into the sickness and maternity fund and 0.5% paid into the occupational accident and disease benefit fund. With regard to foreign workers, they shall make a social insurance contribution of 5% from January 1st, 2022 and enterprises have to additionally make a social insurance contribution of 14% in order to pay into the retirement and survivorship allowance fund.
Foreign worker’s monthly salary on which social insurance contributions are based includes salary, salary allowances and other additions as prescribed in Article 30 of Circular No. 59/2015/TT-BLDTBXH.
Regarding social insurance benefits, from December 1st, 2018 to the day before January 1st, 2022, foreigners are just entitled to enjoy sickness insurance benefit, maternity benefit and occupational accident and occupational disease benefit. With regard to retirement benefit, one-off social insurance benefit, death benefit, they shall be entitled to enjoy from January 1st, 2022.
