Decree No. 38/2015/ND-CP dated April 24, 2015 of the Government on management of waste and discarded materials

According to the new provisions, traders that directly import discarded materials as production materials shall pay imported discarded material deposit to remedy environmental pollution risks caused by imported discarded material shipments.
The deposit amount shall be between 10% and 20% of the total value of imported discarded material shipments depending on type and amount of discarded material imported (Article 59). Organizations and individuals importing discarded materials must deposit prior to customs clearance procedures for imported discarded materials at least 15 working days (Article 59). In case of import under entrustment, the trader importing under entrustment shall be responsible for paying the deposit. (Clause 2 Article 56)
In addition, this Decree also supplements the provision that owners of these projects must register for industrial waste generators and apply for emission permission, including: Steel Production, thermoelectric, cement, chemicals and chemical fertilizers; petroleum production industry; industrial boiler (Article 45, 46)
This Decree shall take effect from June 15, 2015.
The articles (except Articles 7, 8, 9, 10, 11, 13, 15, 16, 17, 18) of the Government's Decree No. 59/2007 / ND-CP dated April 9, 2007; Clause 4 of Article 4, Clause 6 of Article 4, Clause 3 of Article 45 of the Government’s Decree No. 80/2014 / ND-CP dated August 6, 2014; Point 1.3, Section X, Part A, detailed list of charges and fees enclosed herewith with the Government’s Decree No. 24/2006/ND-CP dated March 6, 2006; the Government’s Decree No. 174/2007/ND-CP dated November 29, 2007 shall be invalid from the date this Decree takes effect.
