Regarding subjects exempt from licensing fee, this Circular supplements some cases such as individuals, groups of individuals and households engaging in business with annual revenues of less than or equal to VND 100 million; individuals, groups of individuals and households engaging in irregular business or business without fixed locations. In which individuals without fixed locations also include lottery agents, insurance agents, or agents charging designated selling prices (Article 3)
Regarding amounts of licensing fees, enterprises have to pay 2 rates: VND 2,000,000 per year or VND 3,000,000 per year, depending on their investment capital (Clause 1 Article 4).
In addition, according to this Circular, if an entity engaging in business notifies a tax authority of the business suspension for the full calendar year, it is not required to pay the license fee for year of business suspension (Clause 3 Article 4)
This Circular takes effect from January 1st, 2017.
The licensing fee payers are organizations and individuals that operating their trade/production of goods and services, including not only enterprises, cooperatives, non-business units, branches, representative offices, business locations but also individuals, groups of individuals and households that have their trade/production activities (Article 2)
However, the cases mentioned in Article 3 of this Decree shall be exempt from licensing fees, such as: individuals, groups of individual and households that have their trade/production activities with annual revenue of less than 100 million dong; individuals, groups of individual and households that have their irregular trade/production activities without fixed location; organizations, individuals, groups of individual and households that do the aquaculture, fisheries and fishing logistic services, etc.
The rate of licensing fees is specified according to each type of payers and charter capital or investment capital, in particular: For enterprises with charter capital and investment capital over 10 billion dong, they shall pay licensing fees of 3,000,000 dong/year; enterprises with charter capital and investment capital of less than 10 billion dong, they shall pay licensing fees of 2,000,000 dong/year (points a and b Clause 1 Article 4)
For branches, representative offices, business locations, the common rate of licensing fees is 1,000,000 dong/year, regardless of capital scale (point c Clause 1 Article 4)
For individuals and households, there are 3 rates of licensing fees: 1,000,000 dong/year (if revenue is over 500 million dong/year); 500,000 dong/year (if revenue is between 300 and 500 million dong/year; 300,000 dong/year (if revenue is between 100 and 300 million dong/year) (Clause 2 Article 4).
This Decree shall take effect from January 1st, 2017.
This Decree replaces Decree No. 75/2002/ND-CP dated August 30th, 2002 and Article 18 of Decree No. 83/2013/ND-CP dated July 22nd, 2013.
