In addition, the import of trees with nursery containers may contain harmful organisms with high risks to plants' safety and affecting the country's agricultural production.
As the result, the Ministry of Agriculture and Rural Development has announced that (at Official letter No. 10411/TB-BNN-BVTV dated December 14th, 2017), from January 1st, 2018, to suspend the consideration for settlement of request for import, transit of trees with nursery containers into Vietnam.
With regard to cases in which the Ministry of Agriculture and Rural Development allowed the import before January 1st, 2018 shall be further allowable to carry out procedures for quarantine of imported plants.
Official Letter No. 3914/TCHQ-TXNK - Regarding HS codes of seeds ( 14-Jun-2017) According to note 3 Chapter 12 of the List of Vietnam's imports and export issued together with Circular No. 103/2015/TT-BTC: Group 12.09 applies to beet seeds, grass and other herbage seeds, seeds of ornamental flowers, vegetable seeds, seeds of forest trees, seeds of fruit trees, seeds of vetches (other than those of the species Vicia faba) or of lupines are to be regarded as “seeds of a kind used for sowing”". read more
However, heading 12.09 does not apply to the following even if for sowing:
(a) Leguminous vegetables or sweet corn (Chapter 7);
Applicable entities of this table of HS codes are Lists of plant varieties permitted for production, trading in Vietnam promulgated in 32 Decisions, Circulars of the Ministry of Agriculture and Rural Development (the details are provided in Appendix 02).
This Decision takes effect from the date of its signing.
This Decree applies to organizations and individuals involved in production and use of herbal ingredients in the territory of Vietnam.
This Decree takes effect from July 5th, 2017. To replace the regulations on provision of assistance for production of herbal ingredients specified in Article 12 of Decree No. 210/2013/ND-CP dated December 19th, 2013.
Accordingly, the following entities shall apply for permits if they wish to use genetic resources under the sovereignty of Vietnam
- Vietnamese organizations and individuals that seek access to genetic resources for commercial purposes and commercial product development purposes;
- Foreign organizations and individuals that seek access to genetic resources in Vietnam for any purposes;
- Vietnamese organizations and individuals that wish to take genetic resources abroad.
The Ministry of Agriculture and Rural Development shall issue, extend and revoke the permit relating to genetic resources of crop varieties, breeds of livestock and aquatic animals and varieties of forest trees.
The maximum validity period of the permit is not exceeding 3 years.
The process of application for a permit comprise these steps: Register access to genetic resources with a permitting authority; Negotiate and conclude the Mutually Agreed Terms (MAT) with the Provider; Have the MAT certified by the People's Committee of the commune; Submit an application for the permit to the permitting authority.
This Decree takes effect from July 1st, 2017. To abolished Article 18, Article 19, Article 20 of Decree No. 65/2010/ND-CP dated June 11th, 2010.
Accordingly, with regard to domestically – produced plant varieties, the producer may either carry out the self-assessment or hire a certifying organization to carry out the certification of conformity for plant varieties
However, for plant varieties imported, the conformity must be assessed by a certifying organization. A certificate of plant variety import conformity or the report of appraisal, as issued by the certifying organization designated, is the groundwork of customs authorities’ clearance of the variety imports (Article 4)
