Accordingly, the registration for inspection of quality of group-2 products must be carried out at the Vietnam Telecommunications Authority – the Ministry of Information and Communications at these addresses:
- In Ha Noi: Verification and Certification Center 1, the Viet Nam Telecommunications Authority. Tel: 024.37820992.
- In Da Nang: Verification and Certification Center 3, the Vietnam Telecommunications Authority. Tel: 0236.3897889.
- In Ho Chi Minh city: Verification and Certification Center 2, the Vietnam Telecommunications Authority. Tel: 028.39919066.
Group-2 products shall be granted customs clearance only when the importers present the written registration of quality inspection certified by the Vietnam Telecommunications Authority.
If the aforesaid papers are not available, enterprises have to send a written commitment to customs authorities and the Vietnam Telecommunications Authority on the completion of procedures for certification of conformity with regulations /publication of conformity with regulations within 15 working days from the date of customs clearance.
From August 1st, 2018: When importing group-2 commodities under the specialized management of the Ministry of Information and Communications, enterprises have to present the registration for the quality inspection certified by the specialized inspection agency (the Vietnam Telecommunications Authority) when they carry out procedures for goods clearance according to Decree No. 74/2018/ND).
The application for registration for the quality inspection of commodities shall be carried out according to Clause 2a Article 7 of Decree No. 132/2008/ND-CP (which has been supplemented at Clause 3 Article 1 of Decree No. 74/2018/ND-CP).
Locations of reception of the registration for the quality inspection of commodities: the Vietnam Telecommunications Authority. Of which, in Ha Noi, it is Verification and Certification Center 1; in Ho Chi Minh city it is Verification and Certification Center 2; and in Da Nang it is Verification and Certification Center 3.
Accordingly, under Article 8 of this Law, there are many prohibited acts on cyberspace, such as: provision of false information for the purpose of causing public confusion or economic loss, obstructing regulatory bodies or law enforcers, violating lawful rights and interests of other organizations and individuals; enticing, persuading or tempting others to commits crimes; act of cyberattack, cyber terrorism, cyber espionage and cyber crimes; causing breakdown, attacking, infiltrating, overriding, interfering with, disrupting, paralyzing or sabotaging national security information systems; infiltrating a telecommunications network, the Internets, computer network, information systems, etc.
With regard to websites, web portals and social media pages, Article 26 of this Law bans from providing, posting or popularizing information which commits the regulations in Clauses 1, 2, 3, 4 and 5 Article 16 of this Law and other information that violates national security.
Domestic and overseas providers of telecommunications services, internet services and value-added services in Vietnam’s cyberspace have the responsibility to verify users’ information when they open digital accounts; protect confidentiality of users’ information and accounts; provide users’ information for professional cybersecurity forces upon request; stop providing or refuse to provide the aforementioned services for the organizations or individuals that post the violated information, etc.
Especially, Clause 3 Article 6 also requests overseas enterprises that provide telecommunications services, internet services and value-added services in Vietnam’s cyberspace have to open branches or representative offices in Vietnam. Data about private information, relationships of their service users or data created by their service users in Vietnam shall retain such data for a specific period of time defined by the Government.
1. The List of information and communication technology products and goods subject to the compulsory certification and announcement of regulation conformity (Appendix I);
2. The List of information and communication technology products and goods subject to the compulsory announcement of regulation conformity (Appendix II).
Accordingly, in comparison with the earlier Lists, many products now shall not be subject to the certification of regulation conformity (it is only required to be undergone the announcement of regulation conformity) such as Cordless telephone equipment; xDSL terminal equipment; Data transmission equipment; Terrestrial Trunked Radio (TETRA) equipment; Radio navigation equipment, Amplification equipment in the cable TV distribution system, etc.
Especially, some products shall be exempt from both certification and announcement of regulation conformity such as CDMA 2000 - 1x mobile stations; CDMA 2000-1x terminal equipment; Radio accessing equipment on frequency band of 5GHz; LTE mobile communication repeater, Display transmitter, etc.
These products shall be exempt from the announcement of regulation conformity (under the earlier regulations, they were subject to the announcement of regulation conformity): Personal digital assistant (PDA); Hub; PABX switchboard; Optical transmission devices.
This Circular takes effect from July 1st, 2018 and replaces Circular No. 42/2016/TT-BTTTT dated December 26th, 2016.
Accordingly, in order to be granted a license to establish news websites or license to establish social networking sites, each enterprise must meet requirements of personal, domain name, technical system as follows:
+ There is at least 1 employee in charge of contents who is a Vietnamese or a foreigner obtaining a temporary residence card remaining valid for at least 6 months;
+ There is a division in charge of contents and technical personnel that meet the regulations in Annex II and Annex III issued together with this Decree;
+ A string of domain name is not similar or identical to the name of a news agency;
+ The news website or social networking site must use at least 1 “.vn” domain name
+ The “.vn” domain name must remaining valid for at least 6 months at the time of application for a license;
+ News websites must be able to store contents of news at least 90 days from the posting time and social networking sites must be able to store details associated with accounts, log in time, log out time, IP address of users at least 2 years;
+ There is at least 1 DNS server in Vietnam
This Decree takes effect from April 15th, 2018 and replaces these regulations:
This is the income from royalties on which enterprise income tax shall be paid at the rate of 10% (Clause 2 Article 13 of Circular No. 103/2014/TT-BTC). With regard to value added tax, it shall be exempt according to Clause 21 Article 4 of Circular No. 219/2013/TT-BTC.
