This Decision provides for new responsibility allowances for workplace union representatives and multiple-position allowances for Chairpersons and Deputy Chairpersons of workplace unions.
Accordingly, with regard to workplace union representatives, they shall be entitled to responsibility allowances equaling to 0.05 - 1% of statutory pay rate, depending on their titles and the number of union members at enterprises. Under the earlier regulations, the allowances were equal to 0.12 – 0.3 of the minimum pay rate used for calculation of revenue of trade union funds.
With regard to Chairpersons and Deputy Chairpersons of workplace unions, they shall be entitled to multiple-position allowances equaling to 10 % and 7%, respectively, of the salary as the basis for paying social insurance premiums. Under the earlier regulations, these allowances were equal to 0.2 – 0.7 (Chairpersons) or 0.15 – 0.6 (Deputy chairpersons) of the minimum pay rate used for calculation of revenue of trade union funds, depending on the number of union members at enterprises.
In addition, according to the new regulations, enterprises are allowed to use up to 45% of the retained union fees to pay the aforesaid allowances. Under the earlier regulations, enterprises were allowed to
use up to 30% of revenue of trade union funds and revenue of trade union dues to pay the allowances.
This Decision takes effect from January 1st, 2022 and replaces Decision No. 1439/QD-TLD dated December 14th, 2011.
