Official letter No. 420/LDLD-CSPL dated June 14th, 2021 of Ho Chi Minh city Federation of Labor regarding implementation of regulation pertaining to suspension pay due to Covid-19

Ho Chi Minh city Federation of Labor assumes that employees who have to suspend their work during the period of social distancing under Directive No. 16/CT-TTg dated March 31st, 2021 or have to isolate at rented houses, lodging, export processing zones, industrials parks, enterprises, etc. shall be paid suspension pay according to Clause 3 Article 99 of the Labor Code No. 45/2019/QH14 .

Accordingly, the suspension pay paid for the suspension period of less than 14 working days or for the first 14 days (if the suspension is longer than 14 working days) must not fall below the statutory minimum wages.

For the suspension period after the first 14 days, the payment of suspension pay and suspension pay amount shall be agreed by employer and employees. However, grassroots trade unions will proactively mobilize, negotiate with enterprises to make payment of suspension pay to share difficulties with employees during the pandemic.

In addition, Ho Chi Minh city Federation of Labor requests trade unions of all levels in the City to timely and promptly offer urgent allowances to employees affected by Covid-19 according to Decision No. 2606/QD-TLD dated 19th, 2021 and Official letter No. 374/LDLD-CSPL dated May 28th, 2021.
