This Decree amends some Decrees on penalties for administrative violations, including:

1. Decree No. 71/2019/ND-CPstatus2 on penalties for administrative violations in chemicals and industrial explosive materials;

2. Decree No. 134/2013/ND-CPstatus2 on penalties for administrative violations in electricity;

3. Decree No. 98/2020/ND-CPstatus2 on penalties for administrative violations against regulations on commerce, production and trade in counterfeit goods;

4. Decree No. 99/2020/ND-CPstatus2 on penalties for administrative violations in petroleum and oil, gas trade.

One of the noticeable amendments of this Decree is the increase in maximum fines imposed on violation of regulations on protection of consumer’s rights to VND 200,000,000 (for individual offenders) and VND 400,000,000 (for organization offenders). The old maximum levels were VND 100.000.000 (for individual offenders) and VND 200.000.000 (for organization offenders).

In addition, this Decree also supplements regulations on fines imposed on the act of submitting reports on results of sale promotion program, a fine ranging from VND 1,000,000 to VND 3,000,000 (if the reports are submitted within 30 days from the report deadline) and a fine ranging from VND 3,000,000 to VND 5,000,000 (if the reports are submitted after 30 days or later from the report deadline).

Or a fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed on foreign traders that fail to satisfy requirements and regulations on booths and services when organizing fairs or commercial exhibits in Vietnam.

This Decree takes effect from the date of its signing.
