This Circular provides for specific provisions on classification of timber processing and exporting enterprises according to Decree No. 102/2020/ND-CP.
Accordingly, enterprises may submit applications for enterprise classification online on website: www.kiemlam.org.vn or submit directly to the receiving authority.
Enterprise classification results (Category I or Category II) are also notified on such website if it meets operation requirements.
Notably, a Category I enterprise shall be changed to Category II enterprise if the enterprise of its legal representative is facing criminal prosecution as prescribed in Article 232 of the 2015 Criminal Code and does not yet have their criminal record expunged or has been issued with a decision on administrative penalty imposition issued by a competent authority as prescribed in Clause 4 Article 13 of the Decree No. 102/2020/ND-CP and has undergone the period after which they are regarded as having never been administratively handled.
This Circular takes effect from May 1st, 2022.
