The Ministry of Construction notes that the Law on Real estate trading No. 66/2014/QH13
only provides for scope and forms of real estate trading with regard to FDI enterprises (points b, d, h Clause 1, point b clause 2 Article 11); it does not provide for criteria for determination of FDI enterprises.
The determination of FDI enterprises, including FDI enterprises engaging in real estate trading, is still based on regulations of laws on investment, laws on enterprises and belongs to scope of management of the Ministry of Planning and Investment.
