According to clause 5 Article 1 of Decree No. 30/2021/ND-CP, if there is only one investor that is the winner of the bidding for a commercial housing construction project, it is not required to carry out procedures for recognition of the project owner.
However, if multiple investors are approved, they have to authorize a qualified investor to act as the project owner or establish an organization to carry out procedures for recognition of the commercial housing project owner.
Notably, according to clause 5 Article 1 of Decree No. 30/2021/ND-CP, in the application for recognition of a commercial housing project owner, it is required to have documents proving the rights to use land.
