The Ministry of Construction assumes that applicable laws do not require that contractors performing the construction, providing project-management consultancy, supervision consultancy and designing consultancy must be independent legally and independent financial with regard to construction projects using private funds; It is only required with regard to public investment projects.
However, entities that participate in construction activities have to meet capacity requirements, directly and wholly take responsibilities for quality and safety with regard to tasks they perform (including partners) according to clause 2, clause 3 Article 7 of Decree No. 6/2021/ND-CP .
