Official letter No. 80/BXD-HDXD dated January 7th, 2022 of the Ministry of Construction regarding conditions for exemption from construction permit

According to clause 2 Article 23 of Decree No. 68/2017/ND-CP , construction works in an industrial cluster for which the detailed planning with a scale of 1/500 has been approved and for which the design has been appraised are exempt from construction permits.

However, the Ministry of Construction notes that the amended Law on Construction No. 62/2020/QH14 (takes effect from January 1st, 2021) no longer regulates that the aforesaid cases are exempt from construction permits. Accordingly, from January 1st, 2021 construction works in an industrial cluster for which the detailed planning with a scale of 1/500 has been approved and for which the design has been appraised are still required to apply for construction permits.
