The Ministry of Construction notes that, when conducting real estate trading in Vietnam, foreign-invested enterprises (FDI enterprises) must comply with these regulations:
- They are only entitled to conduct real estate trading in the area beyond national defense and security protection zone (Clause 4 Article 4 of Law Real estate trading No. 66/2014/QH13).
- They must meet the requirements and forms of real estate trading regulated at Article 10, Clause 2 and Clause 3 Article 11 of the Law on Real estate trading and Article 4 of Decree No. 02/2022/ND-CP.
Regarding conditions on capital contribution and ownership rate of foreign investors in the field of real estate trading, it is required to carry out according to the Law on Investment, the Law on Real estate trading and the Law on Housing.
