This Decree provides for conditions for operations of foreign non-governmental organizations in Vietnam and their rights and obligations.
Accordingly, foreign non-governmental organizations that wish to establish head offices or representative offices in Vietnam have to apply for the operation registration certificate.
The Ministry of Foreign Affairs is the agency in charge of issuance, extension, amendments, re-issuance of the operation registration certificate of foreign non-governmental organizations.
Conditions for obtaining the operation registration certificate with regard to foreign non-governmental organizations are regulated at Article 10 of this Decree. In which, the important condition is having specific proposals on the expected programs, projects and non-projects to support development and humanitarian aid in Vietnam within 3 years.
Each foreign non-governmental organization can set up 01 representative office in one of three locations: Hanoi city, Da Nang city and Ho Chi Minh City.
The operation registration certificate is valid for at most 03 years from the date of issuance. The representative office registration certificate is valid for at most 05 years from the date of issuance.
This Decree takes effect from November 1st, 2022 and replaces Decree No. 12/2012/ND-CP dated March 1st, 2012.
