According to clause 1 Article 99 of the Law on Construction No. 50/2014/QH13
, before the expiration of the construction permit for construction commencement, if the construction of the works has not commenced yet, the project owner must apply for extension of the construction permit.
The issuance of the construction permit, including extension and re-issuance of construction permit, with regard to special-grade construction works belongs to competence of provincial-level People’s Committees (clause 37 Article 1 and point c clause 2 Article 3 of Law No. 62/2020/QH14 ).
In addition, the project owner shall pay attention to carry out procedures for notifying construction commencement and perform responsibilities and obligations in the course of construction as regulated at clause 2 Article 55 and Article 56 of Decree No. 15/2021/ND-CP .
