Circular No. 03/2021/TT-BTNMT dated May 12th, 2021 of the Ministry of Natural Resources and Environment on providing guidance on details of plan for use of land upon equitization of state enterprises; formulation and approval of plan for use of land for public service units transformed into joint-stock companies

This Circular provides for guidelines on formulation of plan for use of land upon transformation into joint-stock companies of state enterprises and public service units.

Accordingly, an equitized enterprise shall be responsible for making a report on the current state of management and use of land that they are managing and using till the time of enterprise valuation, and submitting it to the governing body for its approval. The report must fully have the contents as regulated at Clause 1 Article 2 of this Circular.

With regard to plan for use of land upon equitization, enterprises has to base on land use plans and construction plans (if any) of localities; plans for rearrangement of public property; land use plans according to the provisions of Decree No. 118/2014/ND-CP approved by competent authorities and strategies for development of enterprises to make recommendations for land use plan.

In the plan, it is required to have the comparison of the land use plan upon equitization with the plan on land use, construction planning, etc. according to the guidelines provided at Clause 3 Article 2 of this Circular.

This Circular takes effect from June 28th, 2021.
