Decision No. 5175/QD-BYT dated November 9th, 2021 of the Ministry of Health on approval for the guide for lactation rooms in the workplace

This Decision is to approve the Guide for setting up and operating lactation rooms in the workplace such as location of lactation room, quantity of lactation room, criteria for a lactation room, etc.

Accordingly, depending on quantity of female employees, enterprises must ensure the minimum quantity of lactation rooms as follows: 1 room (if there are less than 100 female employees), 2 rooms (if there are from 100 to less than 500 female employees), 3 rooms (if there are from 500 to less than 1,000 female employees) and 4 rooms (if there are from 1,000 female employees or more)

Regarding location of lactation room, it must ensure that the lactation room is no more than 10 minutes walk from the workplace. It is probable to renovate a part of the infirmary, an unoccupied space of the office, separate a corner of an existing room, etc. to set up a lactation room.

Appendix 4. Registration form to use the lactation room

Appendix 5. Regulations in lactation room

Appendix 6. Survey on the use of lactation room

Appendix 7. Quarterly report on operation of lactation room

This Decision takes effect from the date of its signing.

According to clause 5 Article 80 of Decree No. 145/2020/ND-CP, employers are encouraged to provide dedicated rooms for milking and breast milk storage in the workplace if possible. However, a room for milking and breast milk storage is mandatory if the employer has at 1000 female employees or more
