Decree No. 80/2021/ND-CP dated August 26th, 2021 of the Government on elaboration of some articles of the Law on Provision of Assistance for Small and Medium Enterprises

This Decree remains unchanged criteria for identification of small and medium enterprises (SMEs) as regulated at Decree No. 39/2018/ND-CP . The details are provided at Article 5 of this Decree.

However, SMEs shall be entitled to many new assistance policies (from the State) under this Decree, such as:

- Reimbursement of up to 50% of the value of the advisory contract for digitalization but not exceeding 50 million VND/contract/year for each small enterprise and not exceeding 100 million VND/contract/year for each medium enterprise.

- Reimbursement of up to 50% of the cost of leasing, buying solutions for digitalization but not exceeding 20 million VND/year for each micro-enterprise; not exceeding 50 million VND/year for each small enterprise and not exceeding 100 million VND/year for each medium enterprise.

- Reimbursement of up to 50% of the value of the advisory contract for establishment of intellectual property rights but not exceeding 100 VND/contract/year/enterprise.

- Reimbursement of up to 50% of the value of the advisory contract for technology transfer but not exceeding 100 VND/contract/year/enterprise.

In addition, levels of assistance for advisory contracts (about personnel, finance, manufacturing, sale, market, etc.) provided for SMEs are also increased in comparison with those under the earlier regulations. In particular, the maximum assistance provided for a micro-enterprise is 50 million VND/year (the old level was 3 million VND/year); for a small enterprise is 100 million VND/year (the old level was 5 million VND/year); for a medium enterprise is 150 million VND/year (the old level was 10 million VND/year)

This Decree takes effect from October 15th, 2021 and replaces Decree No. 39/2018/ND-CP dated March 11th, 2018.
