Based on clause 4 Article 37 of the Law on Residence No. 68/2020/QH14, the Ministry of Justice promulgated Decision No. 1050/QD-BTP dated June 23rd, 2021 to amend administrative procedures for issuance of judicial record card to foreigners. Accordingly, from July 1st, 2021 the application for the judicial record card of foreigners shall be exempt from certificate of permanent or temporary residence.
However, according to opinions of the Ministry of Justice, now the national database on population does not integrate information of foreigners, Departments of Justice face many difficulties upon determining correct competence to issue judicial record cards to foreigners if there is no certificate of permanent or temporary residence in the application. As the result, now some Departments of Justice still request the submission of certificate of permanent or temporary residence when foreigners apply for the judicial record card.
The Ministry of Justice informs that in the future it will amend Decision No. 1050/QD-BTP, in which the application for judicial record card of foreigners still comprises the certificate of permanent or temporary residence.
