Official letter No. 856/BXD-QLN dated March 15th, 2022 of the Ministry of Construction regarding guidelines for housing-related regulations

Conditions and limit on ownership of houses in Vietnam with regard to foreigners are regulated at point a clause 2 Article 161 of 2014 Law on Housing and clause 1 Article 75 of Decree No. 99/2015/ND-CP .
Accordingly, foreigners are only allowed to own apartments of commercial housing projects and the number of apartments must not exceed 30% of the total number of apartments in the apartment building.
As the result, current regulations do not allow foreigners to own apartments of social housing projects, even commercial apartments of social housing projects.
Regarding selection of investors of social housing projects, according to point d clause 1 Article 3 of Circular No. 09/2021/TT-BXD, in case applying the bidding method, it is required to have detailed construction planning already approved by the authorities.
