This document is to request enterprises in Ho Chi Minh City to report the situation of salary payment for 2022 and plan for bonus for 2023 Tet (using the attached form) before December 25th, 2022 in order for the Department of Labor - Invalids and Social Affairs of Ho Chi Minh City to summarize and report to the Ministry of Labor - Invalids and Social Affairs.
Concurrently, enterprises must soon prepare plan and notify employees of bonuses for Tet 2023 (including allowances, supports for train tickets, cars to go home to celebrate the Tet, etc.) so that employees are comfortable to focus on production, business; in which it is required to disclose in details time of salary payment, bonus provision and time to take Tet break.
The Department of Labor - Invalids and Social Affairs of Ho Chi Minh City also notes that enterprises need to ensure salary payment in full and on time as planned; do not let the situation of salary and bonus debt occur resulting in labor disputes. If enterprises face difficulties in salary and bonus payment, it is necessary to promptly discuss with grassroots trade unions and report to Divisions of Labor - Invalids and Social Affairs, Labor Confederations of districts for coordination support.
Regarding Tet break for the year of the Cat 2023, enterprises must comply with point b clause 1 and clause 3 Article 112 of the Labor Code. In case of combining the Lunar New Year holiday with annual leave, it is required to reach the agreement between the parties and disclose before the implementation.
