Now, the transfer, lease, sub-lease of land use rights shall be carried out according to clause 4 Article 5, clause 2 Article 9 and Section 5 Chapter II of the Law on Real estate trading 2014 and related regulations.
In case of transfer of the whole (or a part) of a real estate project, it shall be carried out according to the regulations at Section 6 Chapter II of the Law on Real estate trading 2014 and Section 3 Chapter II of Decree No. 02/2022/ND-CP.
Notably, according to Article 14 of Decree No. 02/2022/ND-CP, for the case where a contract for real estate trading has been signed before the effective date of this Decree, it is not required to sign the contract again, otherwise it is agreed by the parties.
