Decree No. 126/2021/ND-CP dated December 30th, 2021 of the Government on amendments to certain articles of Decrees on administrative penalties in industrial property; standards, measurement and quality of goods; science and technology activities, technology transfers; atomic energy

This Decree amends some regulations on administrative penalties as follows:

1. Decree No. 99/2013/ND-CP on administrative penalties in industrial property

2. Decree No. 119/2017/ND-CP on penalties for administrative violations against regulations on standards, measurement and quality of goods

3. Decree No 51/2019/ND-CP on administrative fines for violations arising from scientific and technological activities and technology transfer

4. Decree No. 107/2013/ND-CP dated September 20, 2013 on sanctioning of administrative violations in atomic energy

Accordingly, this Decree highly increases fines on violations on industrial property indication (from VND 10,000,000 to VND 20,000,000); industrial property representation right (from VND 6,000,000 to VND 30,000,000); providing industrial property representation services (from VND 30,000,000 to VND 60.000.000).

In addition, some violations such as failing to submit the result of conformity self-assessment within the prescribed time limit for group 2 imports; failing to submit a certified true copy of certificate of quality, etc. shall be also subject to fines.

This Decree takes effect from January 1st, 2022.
