Road map for removal of low-efficiency equipment

fa-check-circle Decision No. 24/2018/QD-TTg dated May 18th, 2018 of the Prime Minister on promulgating the list of low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built, and the roadmap to implementation thereof

This Decision provides for the list of low-efficiency equipment that has to be discarded (except for the equipment that is temporarily imported and re-exported, and serve repair, replacement and energy efficiency testing)

Accordingly, in comparison with the earlier list, the new list adds more some equipment that has to be discarded (prohibited from import, manufacture and domestic sale) if equipment fails to satisfy the minimum energy efficiency standards specified in the national standards, including: refrigerator freezers; non-ducted air conditioners; television sets; computer monitors; copiers; printers and commercial refrigerated cabinets

Road map for discarding: from July 10th, 2018 with regard to any low-efficiency equipment that fails to satisfy the minimum energy efficiency standards specified in the national standards in the Appendix I and from July 10th, 2020 with regad to any low-efficiency equipment that fails to satisfy the minimum energy efficiency standards specified in TCVN in the Appendix II.

Particularly, the list of and road map for banning from new construction of obsolete and low-efficiency generating sets and list of, road map for banning from import of old and obsolete equipment used for generating sets shall be carried out according to Appendix III of this Decision

This Decision takes effect from July 10th, 2018 and replaces Decision No. 78/2013/QD-TTgfa-minus-circle dated December 25th, 2013.

Table of answers to questions concerning lending transactions of banks

fa-check-circle Dispatch No. 1576/NHNN-CSTT dated March 14th, 2017 of the State Bank on response to questions concerning regulations in the Circular No. 39/2016/TT-NHNN

The document is to attach a table of answers to questions concerning regulations on lending transactions of banks provided at Circular No. 39/2016/TT-NHNNfa-exclamation-circle .

Accordingly, regarding applicable entities, the aforesaid Circular No. 39/2016/TT-NHNNfa-exclamation-circle does not apply to the Bank for Social Policies and branches of Vietnamese banks which are established and operate in foreign countries. As the result, lending transactions of the aforesaid bank/banks’ braches shall not comply with Circular No. 39/2016/TT-NHNNfa-exclamation-circle .

Regarding individual borrowing customers regulated in Clause 3 Article 2 of Circular No. 39/2016/TT-NHNNfa-exclamation-circle , they are artels, household businesses or private enterprises. As the result, when artels, household businesses or private enterprises borrow loans, they shall comply with the regulations on lending to individuals.

Clause 4 Article 8 of Circular No. 39/2016/TT-NHNNfa-exclamation-circle only stipulates that credit institutions shall not be allowed to approve loans used for buying gold bullions rather than for buying jewelry. This regulation means the approval of loans for buying jewelry is accepted.

Guidelines on calculation of salary of public officials and public employees from July 1st, 2018

fa-check-circle Circular No. 06/2018/TT-BNV dated May 31st, 2018 of the Ministry of Home Affairs on guidelines for employees on payroll in bodies, organizations and agencies of the Vietnam Communist party and the Government, and political or social organizations and associations

This Circular provides guidelines on calculation of amount of pay, allowance and remuneration for public officials and public employees based on the new statutory pay rate VND 1,390,000 per month regulated at Decree No. 72/2018/ND-CP.

Accordingly, amount of pay, allowance and remuneration of public officials and public employees shall be calculated according to the new statutory pay rate VND 1,390,000 from July 1st, 2018.

Withholding payments and benefits determined based on the statutory pay rate shall be re-calculated from July 1st, 2018.

This Circular takes effect from July 15th, 2018 and replaces Circular No. 02/2017/TT-BNV dated May 12th, 2017.

Conditions for adding copyright fee to taxable value of imports

fa-check-circle Official letter No. 2900/TXNK-TGHQ dated June 7th, 2018 of the General Department of Vietnam Customs regarding copyright fee

According Clause 3 Article 14 of Circular No. 39/2015/TT-BTCfa-exclamation-circle , copyright fee shall be added to taxable value of imports only when these 3 conditions are satisfied:

(1) “It is related to the imports";

(2) “It is paid as a condition for sale transaction of goods”;

(3) “It has not been included in the actual or future payment".

According to the General Department of Vietnam Customs’ opinions, the 1st and 2nd conditions are determined as follows:

- The condition “related to the imports": enterprises shall base on their production process in order to determine whether the payable copyright fee for using trade name of goods is related to imports or not.

- The condition “as a condition for sale transaction": enterprises shall base on the regulations in Clause 6 Article 14 of Circular No. 39/2015/TT-BTCfa-exclamation-circle in order to determine whether the copyright fee meets this condition or not".

Enterprises are entitled to take part in physical inspection of goods

fa-check-circle Official letter No. 1539/GSQL-GQ3 dated May 25th, 2018 of the General Department of Vietnam Customs regarding physical inspection of goods.

Relating to the request for allowing enterprises to take part in the course of physical inspection of goods with regard to consignments with great value (gold, silver, jewelry, diamond, cash), the General Department of Vietnam Customs assumes that applicable laws have regulated this mechanism.

In particular, according to Article 33 of the Customs Law, Article 29 of Decree No. 08/2015/ND-CPfa-exclamation-circle and Article 29 of Circular No. 38/2015/TT-BTCfa-exclamation-circle , the physical inspection of goods of customs authorities shall be carried out with the presence of customs declarants or their lawful representatives after the customs declaration is registered and the goods are transported to location of inspection.

As the result, the physical inspection of goods of customs authorities shall be carried out publicly with the presence of enterprises. Inspection results shall be fully recorded on the system and the inspection result sheet (form 06/PGKQKT/GSQL Annex V issued together with Circular No. 38/2015/TT-BTCfa-exclamation-circle ) which is certified by the enterprises’ representatives.

This Circular provides guidance on the method for determining the price of municipal solid waste treatment service.

Accordingly, the price of municipal solid waste treatment service shall be determined based on these factors: (i) the prime cost for treatment of 01 ton of municipal solid waste; (ii) profit rate (%). In which, the maximum profit rate is not exceeding 5%.

This Circular takes effect from July 1st, 2017.

Regarding financial leasing companies’ import entrustment

fa-check-circle Official letter No. 1559/GSQL-GQ1 dated May 28th, 2018 of the General Department of Vietnam Customs regarding financial leasing companies’ import entrustment

According to opinions of the General Department of Vietnam Customs, current laws do not prohibit financial leasing companies from entrusting the financial lessees to import goods under the financial leasing contracts.

However, “the activity of taking import entrustment” is considered the “commercial intermediary activity” (Clause 11 Article 3 of the Commercial Law No. 36/2005/QH11).

Accordingly, in case a foreign – invested enterprise signs a financial leasing contract concurrently takes the entrustment of import of goods, it must apply for a business license according to point g Clause 1 Article 5 of Decree No. 09/2018/ND-CP.

Specific guidelines on customs fees and charges under new regulations

Relating to customs fees and charges regulated in Circular No. 274/2016/TT-BTC, this Official letter provides guidelines in details fees and charges with regard to each case as follows:

- Customs fees for registration of a declaration sheet: VND 20,000/sheet, applicable to all exported goods and imported goods (including exported goods and imported goods being means of transport by sea, river, railway, or road).

- Customs fees for an application for inspection, surveillance, or suspension of customs procedures for exported goods and imported goods subject to requests for protection of intellectual property rights: VND 200,000/ application.

- Fee for a vehicle in transit by road: VND 200,000/ vehicle.

- Fee for a vehicle in transit by water: VND 500,000/ vehicle

With regard to customs fee for an inbound flight to Vietnamese airports, to apply the fee rate of USD 50/flight according to Circular No. 194/2016/TT-BTC.

The exemption from, cancellation of, custom fee/charge are only applied to the cases prescribed in Article 3 of Circular No. 274/2016/TT-BTC and Article 3 of Circular No. 194/2016/TT-BTC. Accordingly, for cases entitled to exemption from of custom fee/charge under the earlier regulations at Circular No. 172/2010/TT-BTCfa-minus-circle but now they are not prescribed in Circular No. 274/2016/TT-BTC and Circular No. 194/2016/TT-BTC, the custom fee/charge exemption is no longer given.

Fines imposed on administrative violations against regulations on maritime shall be increased

fa-check-circle Decree No. 142/2017/ND-CP dated December 11th, 2017 of the Government on penalties for administrative violations against regulations on maritime

In comparison with the earlier regulations, this Decree increases fine levels or supplements fines imposed on administrative violations against regulations on maritime as follows:

- Illegally entering or leaving the port land area or boarding the ship, a fine ranging VND 200,000 - VND 500,000 shall be increased to VND 500,000 - VND 1,000,000.

- Failure to comply with relevant technical regulations on inspection of quality of port facilities, a fine ranging VND 30,000,000 to VND 60,000,000 shall be supplemented.

- Failure to establish aids to navigation, a fine ranging VND 10,000,000 - VND 20,000,000 shall be increased to VND 20,000,000 - VND 30,000,000.

- Failure to fully formulate a maritime safety plan, a fine ranging VND 10,000,000 - VND 20,000,000 shall be increased to VND 20,000,000 - VND 30,000,000

This Decree takes effect from February 1st, 2018 and replaces Decree No. 93/2013/ND-CPfa-minus-circle dated August 20th, 2013.

It is required to specify business scope upon applying for a license to trade drugs

Aiming to avoid difficulties, the document requests that at the entry "Business scope" in the application for the certificate of eligibility for pharmaceutical trading, certificate of Good Pharmacy Practice (GPP), certificate of Good Distribution Practice (GDP), enterprises have to list business scope corresponding to pharmaceutical business conditions the enterprises apply for and meet.

In particular, they are the scope specified in Article 15 through Article 22, Article 33 and Article 34 of the Law on pharmacy No. 105/2016/QH13fa-exclamation-circle .

With regard to vaccines and biologicals which must be stored in cool condition, the establishments have to also write the vaccines and biologicals at the "Business scope" in the application for the certificates if they apply for and meet the conditions. If the vaccines and biologicals are not written, it means that the establishments do not apply for trading in these items.

With regard to a certificate issued before the effective date of Decree No. 54 (July 1st, 2017) at the Business scope entry, it is determined as follows:

- If it has been written drugs, it means the wholesale of finished medicines, vaccines, medical biological products, medicine-making materials.

- If it has been written finished medicines, it does not include vaccines, medical biological products, medicine-making materials.

New guidelines on drug quality management and testing

fa-check-circle Circular No. 11/2018/TT-BYT dated May 4th, 2018 of the Ministry of Health on drug/drug ingredient quality

According to Article 8 of this Circular, domestic drugs or imported drugs that belong to one of the following categories must undergo testing carried out by a testing facility designated by the Ministry of Health before circulation:

1. Vaccines; Biologicals that are antisera;

2. Biologicals which are derivatives of human blood and plasma;

3. Imported drugs that have the same trade name, active ingredients, concentration and dosage form as those of a proprietary drug having the certificate of drug registration in Vietnam;

4. Drugs produced by foreign manufacturers on the list of manufacturers with drugs that do not conform to quality standards, published by the Ministry of Health.

This Circular takes effect from June 20th, 2018. To abolish Circular No. 09/2010/TT-BYTfa-minus-circle dated April 28th, 2010 and Circular No. 04/2010/TT-BYT dated February 12th, 2010.

Amendments to requirements for listing of securities after consolidation, acquisition

One of the most important amendments of this Circular is the supplementation of requirements for listing of securities on stock exchanges with regard to consolidated enterprises, acquired enterprises.

Accordingly, in case an enterprise listed on Ho Chi Minh Stock Exchange consolidates with/acquires an enterprise that is not yet listed on Ho Chi Minh Stock Exchange or an enterprise listed on Hanoi Stock Exchange consolidates with/acquires an enterprise that is not yet listed on Hanoi Stock Exchange, the consolidated/acquired enterprise can apply for listing on such Stock Exchanges only if has an ROE of at least 5%.

This Circular takes effect from June 1st, 2017.

Regarding deduction of VAT imposed by tax authorities

According to Clause 6 Article 14 of Circular No. 219/2013/TT-BTCfa-exclamation-circle , the VAT paid under a decision on tax imposition made by a customs authority shall be deducted in full, unless penalties for tax evasion, tax fraud.

Accordingly, if VAT incurred by a company is imposed by a customs authority upon the post-clearance inspection but it is not subject to penalties for tax evasion, tax fraud, the already - paid VAT shall be still deducted in full.

Guidance for statement about occupational accidents in maritime sector

fa-check-circle Circular No. 13/2017/TT-BLDTBXH dated May 15th, 2017 of the Ministry of Labour, Invalids and Social Affairs on providing for statement, statistical investigation and reporting on occupational accidents in maritime sector

This Circular provides guidance for statement about occupational accidents occurred within the period of service on board ship of seafarers and cause injuries to any body parts or functions or death of seafarers while they perform duties or do other tasks as assigned by ship-owner or his authorized person

In addition, accidents which occur at reasonable places and times shall be also made statement according to this Circular, including accidents that happen while seafarers move from their residence to ships and vice versa.

Accordingly, if a maritime occupational accident causes death or seriously hurts more than one seafarer within the territorial waters of Vietnam, the employer must make statement about the incident to the nearest Maritime Administration, the Inspectorate of the Provincial Department of Labor, War Invalids and Social Affairs and the Police Department of district where the incident occurs.

If a maritime occupational accident occurs outside the territorial waters of Vietnam, the employer must make statement about the incident to the representative missions of Vietnam in foreign country (where the ship arrives), the Vietnam Maritime Administration and the Inspectorate of Ministry of Labour, War Invalids and Social Affairs.

This Circular takes effect from July 1st, 2017.

Process of extraction and use of water resources

This Circular applies to establishments that have one of the following water extraction works:

a) Surface water reservoirs serving electricity generation with an installed capacity of over 50kW and including irrigation reservoirs in association with hydropower reservoirs;

b) Surface water reservoirs with a capacity of over 0.1 m3 per second in case of supply of water for agricultural production and aquaculture, and over 100 m3 per 24 hours in case of supply of water for other purposes;

c) Drains, pumping stations and other surface water extraction works specified in Points and b of this Circular with a capacity of over 0.1 m3 per second in case of supply of water for agricultural production and aquaculture, and over 100 m3 per 24 hours in case of supply of water for other purposes;

Under this Official letter, it is required to apply for import license for 3 materials for drug manufacture below:

1. Tramadol hydrochloride (for manufacture of Hi-Tavic drug).

2. Phenobarbital (for manufacture of Garnotal drug).

3. Phenobarbital (for manufacture of Phenobarbital drug 100 mg).

Import of Chymotrypsin pharmaceutical ingredient shall be exempt from license

fa-check-circle Official letter No. 9513/QLD-DK dated May 29th, 2018 of the Ministry of Health regarding proclamation of list of materials for drug manufacture allowable to be imported without the requirement of import license of domestic drugs to which the certificate of registration for circulation has been already granted before July 1st, 2014

According to this Official letter, Chymotrypsin which is used as material for manufacture of Alphachymotrypsin - BVP 8400 drug shall be exempt from import license.
